In the case where three brothers were married to three women who were
strangers [to one another] and one of them having died the second
brother addressed to her a Maamar and died, behold, these must perform
halizah but may not be taken in Levirate marriage; for it is said. And
one of them died [etc.] Her husband`s brother shall go in unto her. Only
she who is bound to one levir but not she who is bound to two levirs. R.
Simeon said: He may take in Levirate marriage whichever of these he
wishes and then participate in the halizah with the other. If two brothers were married to two sisters, and one of the brothers died, and afterwards the wife of the second brother died, behold, she is forbidden to him forever, since she was forbidden to him for one moment. |
יבמות 3.9 שלושה אחים נשואים לשלוש נשים נוכרייות, ומת אחד מהן, ועשה בה השני מאמר, ומת-- הרי אלו חולצות, ולא מתייבמות׃ שנאמר ''ומת אחד מהם ובן אין לו ._._׃ יבמה יבוא עליה'' (דברים כה,ה) -- שעליה זיקת יבם אחד, ולא שעליה זיקת שני יבמין׃ רבי שמעון אומר, מייבם לאיזו שירצה, וחולץ לשנייה׃ שני אחים נשואים לשתי אחיות, מת אחד מהן, ואחר כך מתה אשתו של שני-- הרי זו אסורה עליו עולמית, הואיל ונאסרה עליו שעה אחת |
| If two men betrothed two women, and as these were entering into the bridal Chamber, they exchanged the one for the other, behold, they are guilty of an offence against a married woman. If they were brothers they are guilty also of an offence against a brother`s wife. If [the betrothed women] were sisters, they are guilty also on account of the prohibition, [and thou shalt not take] a woman to her Sister. If these were menstruants [they are guilty also] on account of [the Law of the] Menstruant. They must be kept apart for three months, since it is possible that they are pregnant. If they were minors incapable of bearing children, they may be restored at once. If they were priestly women they are disqualified from the priesthood. |
יבמות 3.10 שניים שקידשו שתי נשים, ובשעת כניסתן לחופה החליפו את של זה לזה, ואת של זה לזה-- הרי אלו חייבין משום אשת איש׃ ואם היו אחין, משום אשת אח׃ ואם היו אחיות, משום אישה אל אחותה׃ ואם היו נידות, משום נידה׃ ומפרישין אותן שלושה חודשים, שמא מעוברות הן; ואם היו קטנות ולא היו ראויות לילד, מחזירין אותן מיד׃ ואם היו כוהנות, נפסלו מן הכהונה ומן התרומה |
