[And] how many lashes are given him? Forty save one, as it is said: By number forty, which means, a number coming up to forty. R. Judah says: He is given forty [lashes] in full, and where is the additional lash applied? Between his shoulders. When they estimate the number of lashes he can stand it must be a number divisible by three. 

 מכות 3.10 
כמה מלקין אותו׃ ארבעים חסר אחת-- שנאמר ''במספר׃ ארבעים''  (דברים כה,ב-ג) , מניין שהוא סמוך לארבעים׃ רבי יהודה אומר, ארבעים שלמות; איכן הוא לוקה את היתרה, בין כתפיו

If they estimated him capable of receiving forty, and after receiving some they again estimated him as not capable of enduring forty, he is exempted [from the rest]. If they estimated him fit to receive eighteen, and after he received the same they again estimated him as fit for receiving forty [save one], he is exempted [from the rest]. 
If he committed a transgression which offended against two prohibitions and they made one estimate [for both], he takes his scourging and is quit; if not, he is flogged [for one transgression], is allowed to recover and then is flogged again.

 מכות 3.11 
אין אומדין אותו, אלא מכות הראויות להשתלש׃ אמדוהו לקבל ארבעים, לקה מקצת-- אמרו אינו יכול לקבל ארבעים, פטור; אמדוהו לקבל שמונה עשרה, ומשלקה אמרו יכול הוא לקבל ארבעים-- פטור׃ עבר עבירה שיש בה שני לאוין, אמדוהו אומד אחד-- לוקה ופטור; ואם לאו-- לוקה ומתרפא, וחוזר ולוקה
