204:3 In places where the dead are sent to another city for burial, and
they1 don't know when he was buried, then the mourners who stayed in
their city, as soon as (people) return from the funeral they start to
mourn, and count from then the seven (days) and also the thirty. Those
who go with the dead (person) to his grave, count from the burial, Some
(authorities) say that if the head of the household went with the dead
(person) then those that stayed behind also count from when he was
buried. They estimate according to their opinion when he was buried and
begin to mourn. (The laws of the days between2 are given in Ch.
196:5-6). We especially take the strict view and follow the head of the
household, and those that stayed behind only count from the burial.
However, if the head of the household stayed at his home those who went
with the dead (person) don't follow after him but count from the burial.
1) The mourners who stayed at home and didn't accompany the body to the cemetery. 2) Between the person dying and when he was buried. |
במקומות ששולחים את המת לקברו בעיר אחרת ואינם יודעים מתי יקברוהו אזי האבלים הנשארים בעירם מיד כשחזרו מן הלויה מתחילים להתאבל ומונים מאז שבעה וגם שלשים וההולכים עם המת עד מקום קבורתו מונים משיקבר ויש אומרים דאם גדול הבית הולך עם המת אזי גם הנשארים אינן מונים אלא משיקבר ומשערין לפי אומד הדעת מתי נקבר ומתחילין להתאבל והימים שבינתים דינם כדלעיל סימן קצ''ו סעיף ה' וסעיף ו' ודוקא לחומרא אזלינן בתר גדול הבית דגם הנשארים אינם מונים אלא משיקבר אבל אם גדול הבית נשאר בביתו ההולכים עם המת אינם נגררים אחריו אלא מונים משנקבר |

204:4 One who was drowned or killed by idolators and we haven't found
his grave, all the time that we haven't given up looking for him, the
(relatives) are not considered as ''Onan''1 or mourners, and are even
allowed (marital) relations. From the time that they give up looking
they begin to mourn. If after the mourning days the (body) is found and
they are obliged to bury him, but they don't need to observe any more
mourning, except if it was their father or mother they need to tear
their garments. One who was drowned and had a wife which means that she
can't marry,2 we don't mourn for him, and we don't say Kaddish for him.
Nevetheless, we try to give pleasure to his soul by occasionally leading
the prayers and reading the Haftorah, by blessing with a ''zimun'',3 by
giving charity, by learning, or by hiring someone to learn in his
memory.

| 204:5 One who lost a close relative and he was not there and he was informed at the place where he is, he starts counting for himself from the time he was told, and even if he comes afterwards to the place of the dead one, to the rest of the mourners who started earlier to mourn, he doesn't shorten his mourning (period) because of this. Similarly, even if he wasn't told until he came to the (rest of the) mourners, and the mourners are not where the dead person passed away and not at the place of burial, he still counts for himself from when he was informed. | מי שמת לו קרוב והוא איננו שם ונודע לו במקום אשר הוא שם מונה לעצמו משעה שנודע לו ואפילו בא אחר כך למקום המת אל שאר האבלים שהתחילו מקודם להתאבל לא יקצר אבלתו בשביל זה וכן אפילו אם לא נודע לו עד שבא אל האבלים אלא שהאבלים אינם במקום שמת המת ולא במקום קבורה גם כן מונה לעצמו משעה שנודע לו |
