180:6 One who owes his acquaintance money, and denies it, and it comes to court, and he's found guilty. The court wrote their judgement and gave it to the lender, the Shemittah year doesn't cancel this debt. | מי שהיה חייב לחבירו ממון וכפר ועמדו לדין ונתחייב וכתב הבית דין פסק דין ונתנוהו לידי המלוה אין השביעית משמטתו |
180:7 One who lends (money) to his acquaintance and made a condition
with him that the Shemittah year wouldn't cancel anything, even so it's
cancelled by the Shemittah year. However, if he made a condition with
him, that he wouldn't release him from this debt,1 even if this was a
Shemittah year, it doesn't cancel this debt. Similarly, if he wrote in
the deed the word ''deposit'', it's not cancelled.
1) The condition has to be specific and not general. | המלוה את חבירו והתנה עמו שלא תשמיטנו שביעית אפילו הכי משמטתו אבל אם התנה עמו שלא ישמיט הוא חוב זה אפילו היתה זאת בשנת השמטה אינה משמטתו וכן אם כתב בשטר לשון פקדון אינה משמטת |
180:8 One who lends to his acquaintance for a period of years, and the time of repayment is after the Shemittah year, it's not cancelled, since he couldn't claim it earlier. | המלוה את חבירו לאיזה שנים והגיע זמן הפרעון לאחר השמטה אינה משמטתו כיון שלא היה יכול לתובעו קודם |
