127:12 One who received on himself to fast and was very distressed during his fast, can redeem it with money according to his means, and gives the money to the poor. However a fast undertaken due to a vow cannot be redeemed. Similarly, a fast decreed by the public cannot be redeemed, unless this was a condition (specified) by the public. | מי שקיבל עליו להתענות ומצטער הרבה בתעניתו יכול לפדותו בממון כפי עשרו ונותן את הדמים לעניים אבל בתענית שמחמת נדר לא מהני פדיון וכן בתענית שגזרו הצבור לא מהני פדיון אלא אם כן התנו כן הצבור |
127:13 One who vowed to fast on Monday, Thursday and Monday, is allowed
to change and fast on Thursday, Monday and Thursday, but not any other
days, because we assume that his intention was to them because these are
days of judgement.1
1) Monday and Thursday were the market days, so there were many people present these days. For this reason, the Torah portion was read on these days, because we could be sure of having at least ten (a minyan), and the court would sit on these days to hear the local people's cases. We therefore assume that it does not matter in what order he fasts as long as it is on these days. | מי שנדר להתענות שני חמישי ושני מותר לו להחליף ולהתענות חמישי שני וחמישי אבל לא ימים אחרים כי מסתמא היתה כוונתו להם מפני שהם יומי דדינא |
127:14 The fasts of the Monday, Thursday and Monday that are after
Pesach and Succot, and also the ten days of penitence which one did not
receive at the time of the afternoon prayers, rather one fasts because
this is the custom. Even if he had intended at the time of answering
Amen on ''He who blessed'', while he has not received it at the time of
the afternoon prayers, if a circumcision occurred or redemption of a
first-born or any other festive meal, it is a commandment to eat and he
does not need annulment.1 For everyone who fasts on these days, because
he knows (this is) the custom, he is fasting, and there is no custom to
fast in place of having a festive meal.
1) Of his vow to fast. | תענית שני חמישי ושני שלאחר פסח ושלאחר סוכות וכן בעשרת ימי תשובה שלא קבלו בשעת מנחה אלא שהוא מתענה מכח המנהג ואפילו כוון בשעת עניית אמן על מי שבירך כל שלא קבלו בשעת מנחה אם אירע ברית מילה או פדיון הבן או שאר סעודת מצוה מצוה לאכול ואינו צריך התרה כי כל המתענה בימים אלו על דעת המנהג הוא מתענה והמנהג לא נתיסד להתענות במקום סעודת מצוה |
