פרק ו משנה ו | |
מי שהיה משלך לבור | One who is thrown into a pit |
ואמר | and says that |
כל השומע את קולו | anyone who hears his voice |
יכתב גט לאשתו | should write a get for his wife |
הרי אלו יכתבו ויתנו | they should write and deliver it. |
הבריא שאמר | A well person who says |
כתבו גט לאשתי | "write a get for my wife" (but did not say to deliver it) |
רצה לשחק בה | (we do not deliver the get because we assume that) he intends to tease her. |
מעשה בבריא אחד | There was an occurrence with a well person |
שאמר כתבו גט לאשתי | who said "write a get for my wife" (and did not say to deliver it) |
ועלה לראש הגג | and he ascended to a rooftop |
ונפל ומת | and fell and died, |
אמר רבן שמעון בן גמליאל | Rabban Shimon ben Gamliel says |
אמרו חכמים | the Sages said |
אם מעצמו נפל | if he fell on his own |
הרי זה גט | (and the get is written and delivered before he dies) it is a get, |
ואם הרוח דחאתו | but if the wind pushed him |
אינו גט | it is not a get. |
פרק ו משנה ז | |
אמר לשנים | One who says to two [people] |
תנו גט לאשתי | "give a get to my wife" (but did not explicitly say to write it), |
או לשלשה |
or to three [people] |
כתבו גט ותנו לאשתי | "write a get and give it to my wife" |
הרי אלו יכתבו ויתנו | these [people] write and deliver it. |
אמר לשלשה | If he says to three |
תנו גט לאשתי | "give a get to my wife" |
הרי אלו יאמרו לאחרים | these may say to others |
ויכתבו | to write [sign and deliver] it |
מפני שעשאן בית דין | as he has made them a beis din, |
דברי רבי מאיר | this is the position of Rabi Meir. |
וזו הלכה העלה | The following is the rule brought up |
רבי חנינה איש אונו | by Rabbi Chanina of Ono: |
מבית האסורים | from [Rabbi Akiva, who was in] prison |
מקבל אני | "I have received the rule |
באומר לשלשה | that one who says to three |
תנו גט לאשתי | 'give a get to my wife' |
שיאמרו לאחרים ויכתבו | that they may tell others to write (sign and deliver) it |
מפני שעשאן בית דין | as he has made them a beis din." |
אמר רבי יוסי | Rabbi Yosi said |
נומינו לשליח | "we said to the messenger (Rabbi Chanina) |
אף אנו מקבלים | we too have received the rule |
שאפילו אמר | that even if he says |
לבית דין הגדול שבירושלים | to the great beis din in Jerusalem |
תנו גט לאשתי | 'give a get to my wife' |
שילמדו ויכתבו ויתנו | that they learn [to write a get] and they write it and they deliver it." |
אמר לעשרה | One who says to ten |
כתבו גט לאשתי | "write a get for my wife", |
אחד כותב ושנים חותמין | one writes and two sign, |
כולכם כתבו | [but if he said] "all of you write" |
אחד כותב | one writes |
וכלם חותמין | and all of them sign. |
לפיכך אם מת אחד מהם | Therefore, if one of them dies [before siging] |
הרי הגט בטל | it is an invalid get. |
NOTES
משנה ו
מי שהיה משלך לבור - The man could not be seen, but he also called out his and his wife's identities.
מעשה - The גמרא explains that this case is given to qualify the previous clause of the משנה, in that if למפרא we can see that the בריא did intend to divorce his wife, it may be delivered and is valid.
