שלוח הקן | [The commandment to] send away [a mother bird from] the nest [in order to take its eggs] |
נוהג בארץ ובחוצה לארץ | is practiced in the Land [of Israel] and outside the Land, |
בפני הבית ושלא בפני הבית | before the Temple [while it stood] and not before the Temple, |
בחלין אבל לא במקדשין | by unconsecrated animals but not by consecrated animals. |
חמר בכסוי הדם | The [commandment to] cover the blood [of slaughter] is more stringent |
משלוח הקן | than sending from the nest, |
שכסוי הדם | as covering the blood |
נוהג בחיה ובעוף | as practiced by wild animals and birds, |
במזמן ובשאינו מזמן |
by prepared and by not prepared (i.e. whether or not they are readily available and do not need to be trapped), |
ושלוח הקן | and sending from the nest |
אינו נוהג אלא בעוף | is not practiced but by birds, |
ואינו נוהג | and is not practiced, |
אלא בשאינו מזומן |
except by those that are not prepared. |
איזהו שאינו מזומן | Which are not prepared? |
כגון אוזין ותרנגולין | For example geese and chickens |
שקננו בפרדס | that [having escaped from their owner's house] have nested in an orchard, |
אבל אם קננו בבית | but if they nested in a house, |
וכן יוני הרדסיאות | and similarly Herodian doves (a species of domesticated dove), |
פטור מלשלח |
are exempt from being sent away. (This is derived from where it says כי יקרא קן צפור לפניך, "should a birds nest happen to be before you." If the bird is a domestic species but in the wild, one's finding it is happenstance, but if it's in a house it is not.) |

רובץ על ביצי עוף טהור | that roosts upon eggs of a kosher bird, |
וטהור רובץ על ביצי עוף טמא | and a kosher bird that roost upon eggs of a non-kosher bird, |
פטור מלשלח | is exempt from being sent away. |
קורא זכר | A male partridge [that sits on eggs] |
רבי אליעזר מחיב | Rabbi Eliezer obligates [one to send it away] |
וחכמים פוטרין | and the Sages exempt it. |
