| If a man sold a field, and he [the buyer] having paid part of the purchase price, the vendor proposed, `whenever you desire, bring me the balance and take your own` [sc. The field], that is forbidden. If he lent money on a field and said to him [the debtor], `if you do not repay me within three years, it [the field] is mine` it becomes his; and thus did Boethus b. Zunin do, [acting] with the approval of the Sages. |
מציעא 5.3 מכר לו את השדה, ונתן לו מקצת דמיה, ואמר לו אימתיי שתרצה, הבא מעות וטול את שלך-- אסור׃ הלווהו על שדהו, ואמר לו אם אין אתה נותן לי מכאן ועד שלוש שנים, הרי היא שלי-- הרי היא שלו; כך היה בייתוס בן זונין עושה, על פי חכמים |
| A man may not commission a tradesman on a half profit basis, nor advance money for provisions [to be sold] on half profits, unless he pays him a wage as a worker. Fowls may not be set to brood on half profits, nor may calves or foals be assessed thus, unless he pays him for his labour and foodstuffs. But calves and foals may be accepted [without assessing their value at all] on half profits; and they are bred until a third grown; whilst an ass is bred until it can bear burdens. |
מציעא 5.4 אין מושיבין את החנווני למחצית שכר׃ לא ייתן לו מעות ליקח בהן פירות למחצית שכר, אלא אם כן נתן שכרו כפועל׃ אין מושיבין תרנגולין למחצה, ואין שמין עגלים וסייחים למחצה, אלא אם כן נתן לו שכר עמלו ומזונו׃ אבל מקבלין עגלים וסייחים למחצה, ומגדלין אותן עד שיהו שלושים; וחמור, עד שתהא טוענת |
