If he refunded to him the principal but did not pay him the [additional] Fifth, or if the other excused him the principal though not the Fifth, or excused him both one and the other, with the exception, however, of less than the value of a Perutah on account of the principal, he would not have to go after him. If, however, he paid him the Fifth but did not refund the principal, or where the other excused him the Fifth but not the principal, or even where he remitted him both one and the other, with the exception, however, of the value of a Perutah on account of the principal, he would have to convey it personally to him. |
קמא 9.6 נתן לו את הקרן, ולא נתן לו את החומש, מחל לו על הקרן, ולא מחל לו על החומש, מחל לו על זה ועל זה, חוץ מפחות שווה פרוטה בקרן-- אינו צריך לילך אחריו׃ נתן לו את החומש, ולא נתן לו את הקרן, מחל לו על החומש, ולא מחל לו על הקרן, מחל לו על זה ועל זה, חוץ משווה פרוטה בקרן-- הרי זה צריך לילך אחריו |
If he refunded to him the principal and took an oath regarding the
Fifth, he would have to pay him a Fifth on top of the Fifth and so on
until the principal becomes reduced to less than the value of a Perutah.
So also is the case regarding a deposit, as it is stated: in that which
was delivered him to keep, or in fellowship, or in a thing taken away by
violence, or hath deceived his neighbour, or hath found that which was
lost and lieth concerning it and sweareth falsely, he has to pay the
principal and the Fifth and bring a trespass offering. [If a man says to another] `where is my deposit?` and he replies: `it is lost` [and the depositor then says]. `I put it to you on oath.` and the other replies. `Amen`, if witnesses testify against him that he himself had consumed it, he has to pay only the principal, whereas if he confesses on his own accord he has to repay the principal together with a Fifth and bring a trespass offering. |
קמא 9.7 נתן לו את הקרן, ונשבע לו על החומש-- הרי זה משלם חומש על חומש, עד שיתמעט הקרן משווה פרוטה׃ וכן ''בפיקדון, או בתשומת יד או בגזל, או, עשק את עמיתו׃ או מצא אבידה וכיחש בה, ונשבע על שקר'' (ויקרא ה,כא-כב) -- הרי זה משלם קרן, וחומש, ואשם׃ איכן פקדוני, ואמר לו אבד, משביעך אני, ואמר אמן, והעדים מעידין אותו, שאכלו-- משלם את הקרן; ואם הודה מעצמו-- משלם קרן, וחומש, ואשם |
