אינו שוה And he (the hermaphrodite) is not like
לא לאנשים ולא לנשים neither men nor women
כיצד how?
אין חייבים על טומתו he is not liable for tuma [of a zav or zava when entering the Temple]
ואין שורפין על טומתו and we do not burn [teruma that they have come into contact with] due to his tuma
ואינו נערך  and he cannot be the subject of a vow pertaining to his value
ולא כאנשים לא כנשים Neither like men nor like women
ואינו נמכר בעבד עברי he cannot be sold like a Jewish slave
ולא כאנשים לא כנשים Neither like men nor like women
ואם אמר הריני נזיר and if one says "I am hereby a nazir
שאין זה איש ואשה [on the condition] that this one is not a man or [on the condition that it is not] a woman"
הרי זה נזיר he is thereby a nazir
רבי יוסי אומר Rebbi Yoisi says
אנדרוגנס a hermaphrodite
בריה בפני עצמה is a creature unique to itself
ולא הכריעו בו חבמים and the Sages could not decide about it
אם איש אם אשה if it is a man or if it is a woman
אבל טומטום אינו כן

A tumtum [one who has no externally visible genitalia, though they do may have concealed gonads of a man or a woman]

אלא ספק איש is only a safek man
ספק אשה

[and] a safek woman

שבת פרק א משנה א

יציאות השבת [The melacha of] taking out on Shabbos
שתים שהן ארבע בפנים there are two that are four from inside
ושתים שהן ארבע בחוץ  and there are two that are four from outside
כיצד  how is this?
העני עומד בחוץ The pauper stands outside
ובעל הבית בפנים and the homeowner stands inside
פשט העני את ידו לפנים the pauper stretches his hand inside
ונתן לתוך ידו של בעל הבית and places something in the hand of the homeowner
 או שנטל מתוכה והוציא or takes something from within it [the hand ] and takes that outside
העני חייב ובעל הבית פטור the pauper is liable and the homeowner is not liable
 פשט בעל הבית את ידו לחוץ if the homeowner stretches his hand outside
 ונתן לתוך ידו של עני and places something in the hand of the pauper
או שנטל מתוכה והכניס or takes something from the hand of the pauper and brings that inside
בעל הבית חייב והעני פטור the homeowner is liable and the pauper is not liable
פשט העני את ידו לפנים if the pauper stretches his hand inside
ונטל בעל הבית מתוכה and the homeowner takes something from within it
או שנתן לתוכה והוציא or he [the homeowner] places something in it and [the pauper] take it out
שניהם פטורין both are not liable
פשט בעל הבית את ידו לחוץ if the homeowner stretches his hand outside
ונטל העני מתוכה and the pauper takes something from within it
או שנתן לתוכה והכניס or he [the pauper] places something in it and he [the homeowner] brings it in

NOTES

ה

אין חייבים על טומתו - This is referring to the tuma that is contracted with either the white or red emissions previously mentioned; in fact, even if seen together these do not create liability for enterring the מקדש, as the pasuk says (מזכר עד נקבה תשלחו (ויקרא ה:ג.  The gemara explains that we learn from here that this only applies to those certain to be a male or female.  ואין שורפין על טומתו - This is mentioned separately, as in contrast to liability for entering the מקדש, if both a red and white emission is seen, we do burn the teruma.   ואינו נערך - This is a particular type of vow where a person pledges the value of a person to הקדש.  The reason for this is similar to the reason for tuma of such a person in the מקדש, the relevant pasuk uses language of male and female, leaving this ספק out.  ואינו נמכר בעבד עברי - If a male, he cannot be sold unless a גדול, but if female, she can only be sold if a קטנה, thus, ממ"נ a hermaphrodite cannot be sold.  בריה בפני עצמה - There are those that say רבי יוסי is clarifying the opinion of the ת"ק, while others say he argues, saying that the  אנדרוגנס is a third gender, to whom the rules specific to men or specific to women (e.g. tuma from certain types of emissions) do not apply at all.  Yet another interpretation of רבי יוסי is that he holds that an אנדרוגנס is indeed a ספק man or woman, but also a ספק of being of yet another, third gender.
