and it has ways in which it is not equivalent |
לא לחיה ולא לבהמה |
not to a chaya and not to a beheima |
פרק ב משנה ט |

כיצד שוה לחיה |
How it it [a koiy] equivalent to a chaya? |
דמו טעון כיסוי |
Its blood requires covering [after slaughter] |
כדם החיה |
like the blood of a chaya |
ואין שוחטין אותו |
and it is not slaughtered |
ביום טוב |
on yom tov; |
ואם שחטו |
and if it is slaughtered on yom tov |
אין מכסין את דמו |
one does not cover its blood |
וחלבו מטמא |
and its chelev causes tumah |
בטומאת נבילה כחיה |
with tumas n'veila as by a chaya |
וטומאתו בספק |
and its tumah is of an uncertain nature; |
ואין פודין בו |
and we do not redeem [with] it |
פטר חמור |
the first born of a donkey. |
NOTES
משנה ח
כוי - This animal is either a crossbreed of a sheep and deer, or another species bearing similarities to both sheep and deer. Either way, their is a ספק as to whether it is classified as a chaya or beheima.
משנה ט
ואין שוחטין אותו ביום טוב - Dirt may not be dug up for this on yom tov, and while one might think the ashes of an oven, which are considered מוכן for this (and so are not muktzeh) and so may be used for an animal that is ודאי חיה , they are not considered to be prepared for a דבר ספק, like this animal.
