בתרא 1.3 המקיף את חברו משלוש רוחותיו, וגדר את הראשונה ואת השנייה ואת השלישית-- אין מחייבין אותו; רבי יוסי אומר, אם עמד וגדר את הרביעית, מגלגלין עליו את הכול |
| If the party wall of a courtyard falls in, each of the neighbours can be compelled by the other to [contribute to the cost of] rebuilding it to a height of four cubits. [Each of them] is always presumed to have given his share until the other brings a proof that he has not given. For rebuilding higher than four cubits neither can be compelled [to contribute]. If, however, [the one who has not contributed] builds another wall close to it, even though he has not yet put a roofing over the space between, the [pro rata] cost of the whole devolves upon him, and he is presumed not to have given until he adduces proof that he has given. |
בתרא 1.4 כותל חצר שנפל-- מחייבין אותו לבנותו, עד ארבע אמות; בחזקת שנתן, עד שיביא ראיה שלא נתן׃ מארבע אמות ולמעלן, אין מחייבין אותו; סמך לו כותל אחר-- אף על פי שלא נתן עליו את התקרה, מגלגלין עליו את הכול׃ בחזקת שלא נתן, עד שיביא ראיה שנתן |
